BONUS FOR RAILWAY EMPLOYEES 2010-2011

Production Linked Bonus for Railway Employees
The Union Cabinet has accepted the proposal of the Ministry of Railways for payment of Productivity Linked Bonus (PLB) equivalent to 78 days' wages for the financial year 2010-2011 for all eligible non-gazetted Railway employees.

The financial implication of payment of 78 days' PLB to railway employees has been estimated to be Rs.1098.58 crore. The wage calculation ceiling prescribed for payment of PLB to the eligible non-gazetted railway employees is Rs.3500/- p.m.

About 12.61 lakh non-gazetted Railway employees are likely to benefit from the decision.

Payment of PLB to eligible railway employees is made each year before the Dusshera/ Puja holidays. The decision of the Cabinet shall be implemented before the holidays for this year as well.

This will be the highest PLB payment ever to be made by Railways. PLB is based on the productivity indices reflecting the performance of the Railways and its payment is expected to motivate the employees for working towards improving the same in future.

House Rent Allowance not a right, merely a compensation: HC

The HC has ruled that house rent allowance (HRA) is not a right. A division bench of Justice B P Dharmadhikari and Justice A P Bhangale ruled that a government employee not staying in the quarters despite its availability can be disentitled from claiming the special allowance. The bench was hearing a petition filed by the defence ministry against its employees working in the ordinance factory in Nagpur, who were staying in their own accommodation.

Nagpur has surplus government accommodation and is one of the few cities where a central government employee, who lives in his own house has to submit a "non-availability certificate" before he can ask for HRA. The government claimed that its employees, who are offered accommodation but refuse to occupy the same, would not be entitled to HRA.

"HRA is not a matter of right, it is a compensatory allowance given by an employer towards the rental accommodation expenses when the government is unable to provide suitable accommodation to its employee," said the judges. "The employee, if he resides in his own property, may not be entitled to claim the HRA, because it is paid to central government employees to compensate them partly for the especially higher rents which they have to pay for hired or rented residential accommodation in big cities, but not as a source of profit," they added.

The court quashed an order of the central administrative tribunal asking the government to pay HRA to employees who had were residing in their own houses. "Prima facie in our opinion, the pre-requisite for a non-availability certificate (NAC) as laid down in the office memorandum as operative in Nagpur, when central government accommodation is available in surplus and the government is required to spend huge amounts towards construction and maintenance (of the quarters), it is neither arbitrary nor malafide," said the judges.

67% teachers are not comfortable with CCE'

A nationwide survey of the Comprehensive and Continuous Evaluation (CCE) scheme has thrown up significant findings. Two years after CBSE introduced CCE system, a staggering 67% of the teachers are still grappling with it, while 58% of them have a negative or indifferent approach towards it. The only stakeholders of the scheme who are in favour of it are the students - 64% of the students from the surveyed schools find the new system better.

The survey was done by the National Association of School Principals in July, after declaration of the CBSE Board results in May/June this year. A questionnaire based on CCE was sent to all the schools on a random basis, of which 260 schools affiliated to CBSE responded. CBSE has around 10,000 schools under its fold in India and abroad.

Of the 260 schools surveyed, 151 felt that teachers still have a negative or indifferent attitude towards the system. Meanwhile, 62% of the parents felt that CCE is not a better system, while 56% of the schools felt that there is room for improvement.

Reacting to the findings, principal of Ahlcon International School, Mayur Vihar, Ashok Pandey, said, "With the exception of the competitive spirit and performance quality, I will in general agree with the findings regarding the lack of clarity among teachers and parents, lack of adequate training and the long-term efficacy of the system. The basic problem lies in the co-scholastic areas."

Students, however, seem to have taken to the system. "The reason is that since the introduction of the system, the curriculum structure has been revised for the third time and has been divided into formative and summative assessment. This has lessened the volume of scholastic assessment. Integration of projects and field trips make the exercise enjoyable," added Pandey.

   Attention is invited to Board’s letter No. E(P&A)II/2004/HRA-l6 dated 28.1.2005 and letter of even number dated 12.9.2008 regarding re-classification of cities/towns on the basis of 2001 Census for the purpose of grant of House Rent Allowance (HRA) to Railway employees.
The Government of Uttar Pradesh vide their Notification No. 2l7619-7-0953J/1998 dated 01.10.2009 reconstituted the area of Saharanpur (MB.) by adding certain areas within its Municipal Corporation and re-named as Saharanpur Municipal Corporation, which resulted in an increase in population of ‘Saharanpur Municipal Corporation to qualify it for classification as ‘Y’ class city for the purpose of House Rent Allowance to the Central Government employees.

   2. The President is accordingly, pleased to decide that Saharanpur city (within its Municipal limits) shall stand reclassified as Y’ class city for the purpose of grant of House Rent Allowance to the Railway employees posted there.

   3. These orders shall be effective from 1st June,2011.

   4. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

Facilities for senior citizens at computerized Passenger Reservation System(PRS) centers..

Sub:- Facilities for senior citizens at computerized Passenger Reservation System(PRS) centers..

   A reference has been received from Standing Committee of Voluntary Agencies(SCOVA) wherein it has been inter-alia pointed out that at the reservation counter(s) earmarked for senior citizens at Passenger Reservation System(PRS) centers in metros/big cities, there are long queues and senior citizens have to stand for hours in the queue. As such token system should be introduced at such counters.


  2.In this connection please refer to this office letter No.200l/TG.I/20/P/Token System dated 21.08.2002 regarding introduction of computerised token system at PRS Centers. It is understood that at present this system is operational at some PRS centers viz. Mumbai CSTM, Thane, Hyderabad etc.

   3. The request of SCOVA has been examined and it is desired that wherever, at computerised PRS centers, counters have been earmarked for senior citizens/handicapped persons, zonal Railways should consider provision of sitting arrangements near to that special counter subject to availability of space. It may, however, be ensured that such arrangements should not obstruct the free movement of passengers in the PRS center.

   3.1 Necessary action may be taken accordingly and list of such PRS centers may be sent to this office for information. List of PRS centers where computerised/normal token system is in vogue may also be advised.

   The undersigned is directed to refer to this Department’s O.M. No.20/49/2009-CS- 11(B) dated 22nd June, 2011 by which a new grade of Stenographer Grade ‘D’ (NFSG) was created in grade pay of Rs.4200/- in Pay Band-2 with immediate effect in CSSS Cadre with the condition that the total number in the grade will be restricted to 30% of the sanctioned strength.

   2. Based on the Common Seniority List of Stenographers Grade ‘D’, list of Stenographers Grade ‘D’ who are considered eligible for grant of NFSG is annexed to this OM., subject to their being found suitable by the Internal Committee to be constituted by the Cadre Units as per para 1(b) of the O.M. referred to above. Stenographers Grade ‘D’ from S.No.1 to 33 of Annexure to this O.M. who had already completed the approved service of 5 years as on 22nd June, 2011 may be granted the NFSG w.e.f. 22nd June, 2011 and Stenographers Grade ‘D’ from S.No.34 to 98 of Annexure to this O.M. who have completed the 5 years of approved service on 1st July, 2011 may be granted the NFSG w.e.f. 1st July, 2011,
subject to suitability.

   3. Accordingly, the Cadre Units of CSSS are requested to place the eligible Stenographers Grade ‘D’ as given in Annexure to this O.M. in the NFSG after following the procedure as prescribed in O.M. No.20/49/2009-CS-II(B) dated 22nd June, 2011 and also furnish the details of Stenographers Grade ‘D’, if any, who have not been covered in this order and are eligible for NFSG. A copy of order in NFSG in respect of eligible Stenographers Grade ‘D’ may please be furnished to this Department for the purpose of record.

   4. Cadre Units should send a report to CS-II Division, detailing the officers who have been granted NFSG, by 15th October, 2011.

            This Department has been receiving references regarding revision of Special Allowance and Cash Handling Allowance subsequent to increase in the rate of DA @ 51% w.e.f. 1.1.2011.

2.         This Department's O.M.No.4/6/2008-Estt.(Pay II) dated 1st October,2008 states that the rates of Special Allowance and Cash Handling Allowance will be automatically increased by 25% every time the Dearness Allowance payable on revised pay scales goes up by 50%.

3.         All Ministries /Deptts. are, therefore, advised to take necessary action accordingly.

DEARNESS ALLOWANCE(DA) JULY 2011 = DEARNESS ALLOWANCE (DA) JANUARY 2012

The one and only news that would bring lots of joy for every central government employee is Dearness Allowance.
Why and what is the reason for this rejoicing?
 Is there not an increase of 3% of their salary as increment yearly?
Yes .It is increasing but not as such as DA.This is evidently truth.
If we observe keenly  the 3% increment  of the salary that we get yearly inspite of the increase in the cost of living is the best.
Why is it so?
The basic format for the calculation of Dearness Allowance is the AICPIN published by LABOUR BUREAU.
The data published in the eve of every month is taken in to account for the calculation of DA.
If it is so on what basis is the data published?
Taking in to account the rates of essential commodities and comparing it to their previous month's rates,points are given.
If the rates have increased  there will be a increase in the points.Whereas in the rates have decreased there will be a decrease in the points.
Here we have to slightly think about this.We receive DA on the basis of the increase in the points which are consequently due to the increase of the rates.We receive DA as compensation for the extra money we have put in to buy the increased  rates of commodities or for the increase in the cost of living.
There is no necessity for this compensation  if there is no inflation in the cost of living.But increment would increase our salary yearly by 3%.
Will the DA compensate with the speed with which the rates of commodities have risen?
We can surely say NO to this.
This is the same condition for the DA that is to be announced in the MONTH OF JANUARY 2012 and for each and every forthcoming DA's(DEARNESS ALLOWANCES).

DEARNESS ALLOWANCE (DA) FROM JULY 2011

Release of additional instalment of Dearness Allowance to Central Government employees and Dearness Relief to pensioners
The Union Cabinet today approved release of additional instalment of Dearness Allowance to Central Government employees and Dearness Relief to pensioners as due from 01.07.2011 at the rate of 7 per cent over the existing rate of 51 per cent.

The total financial implications on account of both Dearness Allowance and Dearness Relief would be Rs.7228.76 crore per annum and Rs.4819.22 crore in the current financial year.

DA likely to be raised by 7%

 The Cabinet may on Thursday raise dearness allowance (DA) for central government employees and dearness relief (DR) for pensioners by 7 percentage points to 58% of the basic pay/pension.
The last hike in DA was in March when the government increased it by 6 percentage points. The Cabinet is expected to take a decision in this regard on Thursday, sources said. The Cabinet is also expected to clear a proposal for giving productivity linked bonus to Railway employees for the year 2010-11, sources added.

With the proposed DA hike, the basic pay of the central government employees (or pensioners as the case may be) would go up by 36% over a two-year period. The hikes will be implemented from July 1, 2011. The combined impact on the exchequer on account of both DA and DR increase between January 2009 and January 2011 is estimated to have crossed Rs 16,000 crore. The measure is set to provide relief to a total of around 5 million central government employees and around 4 million pensioners.

The change in DA, which is linked to the consumer price index, has lead to a further change in other allowance structure since rate breached the 50% of basic pay mark in March. For instance, payments like conveyance allowance and children’s education allowance have also gone up by 25%. This hike is in accordance to the formula given in the sixth pay commission report which says: “The rates of these allowances will be increased by 25% every time the DA payable on revised pay scales goes up by 50%.” As a result, there will also be an increase in the special compensatory allowance for the central government employees posted in remote areas such as the north-east and Jammu & Kashmir. Their special allowance also goes up by 25% the moment the 50% trigger was breached. The increased DA and DR are expected to help the households of central government employees and pensioners who are already exposed high inflation.

The Cabinet is also expected to clear the Delhi-Mumbai Industrial Corridor project being implemented in collaboration with Japan at Thursday’s meeting. The project was conceived five years ago and envisages setting up of industrial corridor along the Delhi-Mumbai stretch. It will comprise seven new cities, nine industrial parks, three ports, six airports and a 1,483 km high-speed rail and road line will be developed as a trading hub. The States covered by the project include Uttar Pradesh, Haryana, Rajasthan, Gujarat, Maharashtra and Madhya Pradesh.

The Cabinet will also take up for consideration the national manufacturing policy that aims at raising contribution of manufacturing in GDP from 16% to 26% by 2025 and creating 100 million jobs in next 10 years. Manufacturing sector contributes over 80% to the overall industrial production.

Railway minister promises 78-day bonus to staff

The railway ministry on Tuesday assured 78 days’ productivity-linked bonus (PLB) to its employees in the grade pay ranging from Rs 1,800 to Rs 4,600, thus entailing an additional burden of Rs 600-700 crore on the finances of the public-sector employer.

The promise came from railway minister Dinesh Trivedi in a meeting here with federations of the ministry, sources said.

PLB is linked to NTKM (net tonne km traffic) earning divided by the number of employees.Though there has been a 83.37 per cent increase in passenger traffic and 74.95 per cent increase in goods traffic in terms of kilometres covered between 2000-2001 and 2008-2009, staff strength has been reduced by 10.29 per cent.
The PLB paid to approximately 13 lakh employees will amount to Rs 8,975 per employee. According to the Bonus Act, the maximum bonus allowed to the employee for 30 days is Rs 3,500. Actually, the federations had demanded 80 days’ bonus and had asked for PLB to the employees equal to their per day salary earning.

The railways has responded to this saying any enhancement in the bonus limit can happen only by an amendment in the Bonus Act.

According to a Federation official, the minister, at the meeting, was “very positive” towards most of the employees’ demands. “Moreover, he assured implementation of the welfare schemes announced in the Railway Budget.”

Bonus and D.A. for central staff may be announced on 15th

According to reliable sources, the Cabinet may consider the proposal of hike of 7% Dearness Allowance w.e.f 01.07.2011 and diwali bonus to Central staff day after tomorrow, the 15th September. The railway employees are likely to get 78 days PLB, while the other Govt. employees may get 30 days' adhoc bonus, as per sources.

Central govt staff to get bonus

New Delhi, Sep 13 (PTI) Ahead of the festival season, the Government today announced an ad-hoc bonus of up to Rs 3,500 to Group C and D central government employees and personnel of the armed and para military forces.
The government has sanctioned grant of non-productivity linked bonus (ad-hoc bonus) equivalent to 30 days emoluments for the accounting year 2010-11 to the central government employees (Group C and D), a Finance Ministry's office memorandum said.
The limit for bonus is Rs 3,500, it added.
The bonus will also be given to all non-gazetted employees in Group B, who are not covered by any productivity- linked bonus scheme.
"The payment will also be admissible to the central Police and para-military personnel and personnel of armed forces,"it added.
Employees of the Union Territory Administration, which follows the central government pattern of emoluments and not covered by any other bonus or ex-gratia scheme would also be eligible for this ad-hoc bonus.
The expenditure incurred on this account will be debitable to the respective heads to which the pay and allowances of these employees are debited, the Finance Ministry said.

Subject: Fresh empanelment of private hospitals and revision of package rates applicable under CGHS, Mumbai – Clarification regarding.

The undersigned is directed to invite reference to the Office Memorandum of even number dated 1st September, 2011 on the above subject, vide which inter alia revised package rates applicable under CGHS, Mumbai were notified and to state that that in response to several representations received by this Ministry with requests for correction of typographical and other anomalies in the notified rates, the rates earlier notified for empanelment for empanelled hospitals under CGHS, Mumbai have now been reviewed.

2. Accordingly, a corrected list of package rates applicable for empanelled hospitals under CGHS, Mumbai is enclosed.


3.The hospitals, which are already empanelled / being empanelled under continuous empanelment scheme under CGHS, Mumbai are hereby requested to take note of the corrected rates (The bills already cleared will not be reopened.)

4. The other hospitals shortlisted for consideration of empanelment are also requested to accept the corrected rates and come forward to sign MOAs with Addl. Director, CGHS, Mumbai.

One Rank One Pension

Pension improvement is an ongoing process. Considerable improvements have been made in the pensions of armed forces personnel.

A Committee was set up under the Chairmanship of Cabinet Secretary to look into the issue of 'One Rank One Pension and other related matters'. After considering all aspects of the matter, the Committee did not find it feasible to recommend One Rank One Pension. However, keeping in mind the spirit of the demand, several other recommendations to substantially improve pensionary benefits of Personnel Below Officer Rank (PBOR) and Commissioned Officers were made, which have been accepted by the Government and orders in implementation of all the recommendations have been issued. These are available at www.pcdapension.nic.in. Implementation of these orders has not only significantly reduced the gap between the past and the current pensioners but has also considerably improved the pension of ex-servicemen including disabled ex-servicemen.

As per yearly statement of booking of Defence Pension Expenditure during year 2009-10 & 2010-11, the entire amount allotted for Defence Pension Expenditure has been booked in full and no amount is lying unspent.

This information was given by Minister of State for Defence Shri MM Pallam Raju in a written reply to Shri Jyoti Mirdha and others in Lok Sabha today.

Reservation for Ex-Servicemen

There is no provision for earmarking of posts exclusively for ex- servicemen therefore the data on the actual number of reserved posts and unfilled vacancies earmarked for the Ex-servicemen are not maintained. However, percentagewise reservations ranging from 10 to 24.5% of the total available vacancies in Group C & D posts in Government jobs and Public Sector Undertakings have been provided for the willing and eligible Ex- servicemen.

It is the responsibility of concerned organization to fill the vacant posts. However the government endeavours to explore every possible avenue for increasing employment opportunities for the Ex-servicemen through various initiatives including trainings and awareness programmes. Moreover, the State Governments have also been advised to fill up the vacancies reserved for Ex-servicemen expeditiously. Since the Department of Ex-servicemen Welfare has no mandate to monitor the job reservations for Ex-servicemen, the matter has been taken up with Cabinet Secretariat in consultation with Department of Personnel & Training to empower Department of Ex-servicemen Welfare to monitor the same through appropriate changes in relevant rules.

Pension row: HC reprieve for cop's kin


The Madurai bench of the Madras high court has quashed an order of the superintendent of police, Tirunelveli for recovering a sum from the daughter of a deceased sub-inspector on the grounds that his pension benefits were disbursed on wrong calculation. T Josehphine Latha of Tirunelveli had challenged the order of SP, Tirunelveli issued on September 3, 2010 directing her to return the amount which was excessively disbursed as pension benefits to her, after the death of her father, stating that it was fixed wrongly.

The petitioner said that in his order, the SP directed the recovery of a sum of

Rs 32,167 from the legal representatives of late A Thanislas, who died in a road accident on September 2, 2004, when he was working as special sub-inspector of police

in Tirunelveli. Subsequent to her father's death, her mother died on March 7, 2008 and Rs 7,04,578 as pension benefits were disbursed to her.

Latha contended that without giving an opportunity and after a lapse of more than 10 years, the recovery was sought to be made. According to her, the fixation of pay scale to her father was not made on the representation of her father. Therefore, it was not open to the SP to issue the impugned order of recovery after six years of disbursements. Setting aside the order of the SP, Justice S Manikumar observed, "In view of the manifest illegality in the impugned order, wherein the violation of principals of natural justice, is explicit". The judge further observed, "Considering the fact that recovery has been ordered after a lapse of 10 years from service from the date of fixation of pay scale and after the demise of the government servant, this court is of the opinion that the legal representative should not penalise, even assuming that there was any error in fixation of pay scale."

Regarding payment of interest on delayed payment of gratuity

Subject: Regarding payment of interest on delayed payment of gratuity.

           A number of proposals are being received from various departments seeking approval for payment of interest on delayed payment of gratuity in respect of retired government servants on account of administrative lapses.

          The attention of all the Departments is invited to the provisions laid down in RuIe-68 of CCS (Pension) Rules, 1972 and Government of India’s decisions thereunder. It has been provided that, if the payment of gratuity has been authorized later than the date when its payment becomes due, and it is clearly established that the delay in payment was attributable to administrative lapses, interest shall be paid at such rate as may be prescribed, and in accordance with instructions issued from time to time. In all cases where the payment of interest has been sanctioned by the department with the approval of the competent authority, such department shall fix responsibility and take disciplinary action against the government servant or servants responsible for the delay.

         All necessary steps should, therefore, be taken by the Head of Office for ensuring that payment of interest on delayed payment of gratuity is avoided. Officials dealing with such files should be held accountable and responsibility be fixed for not taking timely action in this regard.


        However, where disciplinary or judicial proceedings against a government servant are pending on the date of his retirement, no gratuity is to be paid until conclusion of the proceedings and issue of final orders thereon.

        Henceforth, it has been decided that in all cases of payment of interest on delayed payment of gratuity attributable to administrative delays [barring cases where disciplinary or judicial proceedings against a government servant are pending on the date of his retirement] action will be taken against officials responsible for such delays which may include recovery of the amount of Interest paid on account of delayed payment of gratuity from the salary of delinquent officers/officials.

Sub: Instructions on booking of tickets from an agency other than the authorized travel agents.

Attention is invited to Ministry of Finance, Deptt of Expenditure, 0M No. 19024/1/2009-EIV dated 16.9.2010 reiterating guidelines on Air Travel on Tours)LTC, circulated vide this HQrs office circular bearing No.AN/XIV/VIth CPC/Circular/Vol-IV dated 16/09/2010.


2. Recently, several cases have been received in this HQrs office seeking clarification on admissibility of TA/DA/LTC claims, on journeys performed by Air India/Private airlines by officers, on Tour/LTC by purchasing air tickets through a private travel agent other than Balmer Lawrie & Company and M/s Ashok Travels & Tours in violations of the guidelines laid down in Ministry of Finance, Deptt of Expenditure, 0M dated 16/09/2010.


2. In this connection it is once again reiterated that in terms of the provisions contained in MoF, Deptt. of Expenditure 0M dated 16/09/2010, air tickets may be purchased directly from Airlines (at Booking counters/Website of Airlines) or by utilizing the services of Authorized Travel Agents viz M/S Balmer Lawrie & Company. MIs Ashok Travels & Tours. In the event of air journey being performed by private airlines on Tour/LTC, by seeking deviations from Ministry of Civil Aviation, the bookings of tickets is also required to be done invariably through the authorized travel agents only.


3. Ministry of Finance, Deptt of Expenditure, to whom the matter was referred for clarification on the matter have reiterated that the guidelines as laid down in MoF, Deptt of Exp 0M dated 16/09/2010 have to strictly complied with.

4. In view of what has been brought out in preceding paras, it is once again reiterated and enjoined upon all concerned that the guidelines laid down in Ministry of Finance, Deptt of Expenditure, 0M dated 16/09/2010, regarding air travel and booking of air tickets through the authorized travel agents only, on tour/LTC, have to be strictly complied with. Further in the event of travel by private airlines, where the necessary deviation has or is being sought from Ministry of Civil Aviation, due to non-availability of Air India flights, it may also please be ensured that the bookings for travel on tour/lTC is also done through the authorized travel agents only.


5. The contents of this important circular may please be given wide publicity and brought to the notice of all concerned serving under your office/organization. It may also be brought to the notice of all concerned that no requests for deviations from the above provisions will be entertained by this HQrs office.

Study Leave for Fellowships offered by reputed Institutes

Subject : Study Leave for Fellowships offered by reputed Institutes -

             The feasibility of bringing more Fellowships under the purview of Study Leave, on the same terms and conditions as the Jawaharlal Nehru Memorial Fellowship (JNMF) has been under consideration of this Department for some time. On the basis of the inputs from various Departments/Ministries regarding fellowship offered by reputed Institutions and in consultation  with Department of Expenditure. it has been decided to include the Fellowships offered by (i) K .K. Birla Foundation, (ii) Indian Institutes of Management, (iii) Management Development Institute, Gorgaon and (iv) Lok Nayak Jayaprakash Narayan National Institute of Criminology & Forensic Science on the same terms as that of the fellowship offered by JNMF at present. The following terms will be offered to Central Government employees who are awarded the said fellowship in relaxation of Rule 51, 57 and 59 of Central Civil Services (Leave) Rules, 1972 :-


i)  They will be granted study leave for the entire period of the Fellowship:

ii) They will be entitled to the benefits admissible to them in accordance with the Fellowship and in addition, entitled to draw leave salary only (without allowance) equal to the pay that they drew while on duty with the Government immediately before proceeding on such leave. However, they  will be entitled to Dearness Allowance at the Central Government rates on the leave salary admissible lo them:

iii)  Where considered necessary, the official may be allowed during the period of the Fellowship, the continued use of the facility of the residential telephone officially allotted to him, subject to payment by him of the bills for the rental and call charges of the telephone.

2.  So for as persons serving in the Indian Audit & Accounts Departments are concerned, these orders are being issued after consultation with the C&AG of India.

3.       This order takes effect from the date of issue.
