It has come to the notice that some Local Accounts Offices are not allowing LTC to travel by air from their place of posting (or nearest airport) to a city in the NER to the MCMs who are Non-Gazetted Group ‘B’ officers working in Ordnance Factories, in this connection Government of India, Ministry of Personnel, Public Grievances & Pension, Department of Personnel & Training, Estt. (A) Section, New Delhi OM No. 31011/4/2007-Estt.(A) dated 14-05-2008 regarding clarification of entitlement of travel by air to visit NER and order dated 09-04-2009 alongwith OFB,. Kolkata Note A/I (ID N. 01/CR/A/I/Vol.III/658/LTC dated 08-11-2013) regarding classification of the posts of MCM with reference to Grade Pays are forwarded herewith for information and necessary action of all concerned. As OFB Note specific on a particular post, i.e., MCM, it is directed to treat MCM posts as Group `B’ for all purposes including LTC and CGEGIS.

It is, therefore, requested to take necessary action accordingly. The same may please be circulated to all Branch Accounts Offices under your jurisdiction.

MODIFIED CHARTER OF DEMANDS OF CONFEDERATION

1.      Accept the terms of reference of 7th CPC, submitted by the staff side, National Council JCM.
(a)      To examine the existing structure of pay, allowances and other benefits/facilities, retirement benefits like Pension, Gratuity, other terminal benefits of various categories of Central Government Employees including Gramin Dak Sevaks (GDS) of Postal Department.
(b)      To work out the comprehensive revised pay packet for the categories of Central Government employees including GDS as on 1.1.2014.
(c)       The Commission shall determine the pay structure, benefits, facilities, retirement benefits etc. taking into account the need to provide minimum wage with reference to the recommendation of the 15th Indian Labour Conference (1957) and the subsequent judicial pronouncement of the honorable Supreme Court there-on, as on 1.1.2014.
(d)      To determine the Interim Relief needed to be sanctioned immediately to the Central Government employees including GDS.
(e)       To determine the percentage of Dearness allowance/Dearness Relief immediately to be merged with Pay and pension including GDS.
(f)        To settle the anomalies raised in various fora of JCM.                                                    
(g)      To work out the improvements needed to the existing  retirement benefits, like pension, death cum retirement gratuity, family  pension and other terminal or recurring  benefits maintaining parity amongst past, present and future pensioners and family pensioners including those who entered service on or after 1.1.2004.
(h)      To recommend methods for providing cashless/hassle-free Medicare facilities to the employees and Pensioners including Postal pensioners.

2.      Ensure every five year revision of wages of Central Government Employees in future.
3.      (a) Regularisation of Gramin Dak Sevaks of the Postal Department and grant of Civil Servant status, statutory pension and all other benefits at par with regular employees.
(b) Regularisation and revision of wages of casual and contract workers.
4.      Compassionate appointment – removal of restrictions imposed by Government.
5.      JCM and Anomaly Committee Functioning.
6.      Fill up all vacant posts and creation of new posts wherever justified.
7.      Stop downsizing, outsourcing, contractorisation and privatization of Government functions.
8.      Stop the move to introduce performance related Pay (PRP) system, Extend PLB Bonus for all, removing bonus ceiling.
9.      Revise OTA and Night Duty Allowance rates and clothing rates.
10.  Implement arbitration awards.
11.  Five promotions to all.
12.  Rescind the PFRDA Act. Ensure statutory Pension for all.
13.  Stop price rise. Revive and extend public distribution system for all.
14.  Stop trade Union victimization.
15.  Ensure Right to strike.

CONFEDERATION NATIONAL SECRETARIAT DECIDES TO ORGANIZE PHASED AGITATIONAL PROGRAMMES CULMINATING IN STRIKE

NO COMPROMISE ON THE TERMS OF REFERENCE OF 7th CPC SUBMITTED BY THE STAFF SIDE

1.         The National Secretariat of the Confederation of Central Government Employees and Workers met at New Delhi on 28.11.2013 and reviewed the situation arising out of the Government’s announcement of Seventh Central Pay Commission and the subsequent developments thereon.

2.         Eventhough Government has announced constitution of 7th Central Pay Commission, the appointment is yet to take place. In the meanwhile one round of discussion was held with Secretary, DOP&T on terms of reference. Subsequently, the staff side, JCM National Council has submitted a unanimous proposal on the items to be included in the terms of reference of the 7th CPC, which includes (i) date of effect as 01.01.2014 (2) merger of DA with pay (3) grant of interim relief (4) inclusion of GDS under the ambit of 7th CPC (5) statutory pension for those entered into service on or after 01.01.2004 (6) settlement of anomalies of 6th CPC (7) cashless/hassle-free medicare facilities etc.

Government while announcing the 7th CPC has made it clear that the date of effect will be 01.01.2016. Further nothing has been mentioned about DA merger and interim relief. Regarding GDS the declared stand of the Government is that GDS are not civil servants and in the past also every time when CPC is appointed, the Government refused to include them in the Pay commission. Last time also inspite of the strong protest and agitational programmes conducted by NFPE and Postal JCA, the Government has appointed a bureaucratic committee. Regarding statutory pension to those who entered into service on or after 01.01.2004, the Government’s stand is well known and it may refuse to include this item also in the terms of reference.

This being the position, our past experience shows that unless and until the demands raised in the staff side proposal submitted to Government on terms of reference of the CPC is backed by serious agitational programmes, rallying the entire Central Government Employees and create compulsion on the Government to accept our justified stand, there is every possibility of Government rejecting the above proposal.

Further all of us are aware that the political situation in the country is gradually getting in election mode. This is bringing forth before the working class movement a crucial task of front-loading our class issues in the ensuring political battle. We have to keep in mind that the corporate class and corporate controlled media has started making effort for relegating the working class issues and the economic policy related issues in particular to the background. It is our duty to bring the demands of the working class to the fore-front and conduct intensive campaign against those policies and also against those who are supporting the neo-liberal globalization policies. Confederation of Central Government Employees & Workers being the part and parcel of the mainstream of the working class of our country has got an added responsibility to rally the entire Central Government Employees in the joint struggle against the anti-people and anti-worker policies of the Government which shall ultimately lead to a change in the political equation ensuring implementation of pro-people, pro-worker alternative policy.

Taking into Consideration all the above facts and circumstances, the National Secretariat of the Confederation of Central Government Employees & Workers met at new Delhi on 28.11.2013 took a unanimous decision to go for strike if the Government refuse to accept the staff side proposal on terms of reference. Confederation further decided to organize series of phased programme of action and campaign from now onwards so that the employees will be ready to go for strike on short notice.

It is further decided that Confederation shall not go for any compromise on the demands raised in the proposal submitted by the JCM Staff side on terms of reference of 7th CPC.

3.      The following are the important decision of the National Secretariat.

1.      The earlier decision to defer the strike ballot after the announcement of the 7th CPC by the Government is ratified. Under the given circumstances the decision taken to defer the ballot was perfectly right.

2.      The modification made in the Confederation Charter of Demands regarding date of effect of the 7th CPC (i.e. from 01.01.2011 to 01.01.2014) is approved as it was necessitated for arriving at unanimity among the staff side on term of reference which will strengthen further the unity of all Central Government organizations including Railways and Defence.

3.      Approved the modified Charter of Demands of the Confederation which includes the terms of reference submitted by the Staff side to the Government (copy enclosed Annexure – I)

4.      Decided to conduct the following phased programme of campaign and agitational programmes.
(a)   Convening the Managing bodies/Executive Committees of all affiliated organizations to discuss and ratify the Confederation decision to go for agitational programmes culminating in strike.
(b)   Sector-wise/organisation-wise intensive campaign among the employees by conducting squad work, General body meetings, conventions, postering and issuing printed pamphlets, lunch hour meetings etc, explaining the demands raised in the charter of demands and also the necessity to go for strike if our demands on terms of reference are not accepted. All India/State Leaders of the affiliated organizations shall under-take extensive tour as part of campaign programme.
(c)    The campaign tour programme finalized by the Secretariat meeting earlier is to be implemented. Whereever State level and C-O-C level conventions are yet to be held, it should be held before 20.12.2013. All State Committees and C-O-Cs are requested to organize conventions immediately. The name of the Confederation National leaders who are attending the conventions is given in the enclosed circular. Date of the Conventions may be fixed in consultation with the concerned comrade.
(d)   Decided to conduct nationwide day-long dharna programme at maximum centres, particularly at the state capitals on 2013 December 19th (19.12.2013) with massive participation of employees. Effort is to be made for maximum media coverage of the programmes.
(e)   Decided to organize mass rallies at all State capitals (and if possible at District Capitals also) before 31.12.2013. National leaders of the Confederation and other trade Union leaders may be invited to address the rallies. All effort should be made to make the rally a grand success ensuring maximum participation of employees.
(f)     Decided to conduct press conferences at all State capitals (other centres also if possible) by the State committees/C-O-Cs to explain the justification of demands and also the proposed strike action.
(g)   Decided to organsie nationwide five days relay dharna at various centres of each city during the period from 30th December 2013 to 3rd January 2014 (30.12.2013 to 03.01.2014)
(h)   Mass dharna at New Delhi on 9th January 2014 by All India Leaders of Confederation and leaders of all affiliated organizations and C-O-Cs and also maximum number of employees from Delhi and nearby states.
(i)     Extended National Executive meeting of Confederation will be held at New Delhi on 10.01.2014 (10th January 2014) for declaration of the strike date and also the duration of the strike. All the National Secretariat members of the Confederation, All the C-O-C Representatives and all the Chief Executives of the affiliated organizations of Confederation shall attend the mass dharna on 9th January and the Extended National Executive meeting on 10th January 2014 WITHOUT FAIL. (Please book the up and down ticket immediately to ensure the participation on both days i.e. on 9th & 10th January 2014) If any organisation or C-O-C wants participation of more comrades in the extended National Executive as observers it will be allowed subject to a maximum of five) Participation in the Dharna is allowed without any limit.

5.      Decided to extend full support and solidarity to the proposed strike action of NFPE & FNPO on demands of Gramin Dak Sevaks (GDS) and Casual, Part-time, Contingent employees. It is decided to request the Postal JCA to adjust the date of the strike so that it will be a strike of all Central Government Employees.

6.      Decided to file a case in the Kolkata High Court challenging the PFRDA Bill passed by the Parliament jointly with the All India State Government Employees Federation (AISGEF). The methodology for raising funds for meeting the expenses for the conducting of the case up to Supreme Court will be decided in the next meeting. C-O-C West Bengal is authorized to assist the National Secretariat in completing the formalities for filling the case in the Kolkata High Court in consultation with AISGEF.

7.      Decided to mobilize maximum employees for participating in the 12th December Parliament March organized by the Central Trade Unions against the anti-people, anti-worker policies of the Central Government. C-O-C Delhi and C-O-Cs of nearby states and also all affiliated organizations are requested to ensure large scale participation of the employees in the 12th December Parliament March. It is decided that each organisation shall conduct workers meeting at all important centres in Delhi and nearby states for mobilizing maximum employees to participate in the march.

8.      Decided to extend maximum support and solidarity to the 11th December 2013 Parliament March organized by the AIPEU-GDS (NFPE) demanding settlement of GDS demands. Delhi C-O-C is requested to extent maximum support for the successful conduct of the GDS Parliament March.

9.      The National Secretariat placed on record its sincere thanks to all the state committees/C-O-Cs and also all the affiliated organisations for making the All India Trade Union Education Camp conducted at Mumbai on 14th & 15th November 2013 and also the All India Women’s Convention held at Delhi on 25th & 26th November 2013 a grand success, especially to the C-O-C Mumbai and C-O-C Delhi for providing all the infra-structural facilities in an excellent manner.

10.  Decided to appeal to all affiliated organisations to clear the quota dues towards Confederation CHQ before 31.12.2013.  Financial Secretary shall issue separate notices to each organisation indicating the total dues to be remitted.

11.  It is decided that Com. M. Krishnan, Secretary General shall represent the Confederation as an official delegate in the International Congress of Southern Initiative on Globalisation and Trade Union Rights (SIGTUR) to be held at Perth, Australia from 2nd to 6th December 2013.

The National Secretariat meeting was presided over by Com. K. K. N. Kutty, the National President. Com. S. K. Vyasji, Advisor, was present and gave his valuable guidance for arriving at correct conclusion and decisions on each agenda items. Com. M. The present Secretary Expenditure may be appointed as Member- Secretary of 7th CPC.

The Central  Government is likely to notify the the pay commission within the next two months The timing is in such a way that it is well before the model code of conduct for the general elections comes into force. Such a move will bring a positive mood for the central government employees towards the government. Additionally the Center is expected to give the panel enough time to prepare its report in the hope that the government would be a lot more comfortable vis-a-vis the fiscal deficit by the time the panel submits its report.Government employees have also asked the Center to consider merging dearness allowance with their pay, arguing that the Sixth Pay Commission, like the Centre, could not have anticipated the high inflation that has eroded real wages over the last decade. The demand was made at a preliminary meeting held between the department of personnel and the employee representatives to discuss the proposed Seventh Pay Commission. It is learnt that the present Secretary Expenditure, R S Gujral, is likely to be appointed Member-Secretary of the 7th Pay Commission. The 1976 batch IAS officer of Haryana cadre Gujral is retiring on November 30th  2013. Shri Gujral was also Secretary ( Revenue) and having sufficient experience on functioning of CBEC & CBDT.

Parliamentary Consultative Committee on Railways meets

The Minister of Railways, Shri Mallikarjun Kharge said that Indian Railways will take all possible steps to further improve Railway Claim System so as to make it more passenger-friendly. Speaking at the Consultative Committee meeting of Members of Parliament for Ministry of Railways which held at Bangalore today i.e. 29.11.2013, Shri Kharge said that vision of Indian Railways is to make its operation seamless and free of accidents. However, when some accidents occur, at such time, it is the endeavour of Indian Railways that victims or their dependents are given quick medical and monetary relief. For stranded victims, the Traffic Commercial Staff play a crucial role at the accident site by dispensing ex-gratia to victim/dependents for their immediate needs, he said.

The Railway Minister further said that in the case of loss/damage of goods/parcels, obtaining compensation from Railways has become less problematic with the online registration of claims. He said that Indian Railways has set up 21 Benches if Railway Claim Tribunal at 19 major cities and now the process of filing and settlement of claims have become more customer and user friendly.

This is the first meeting of the Consultative Committee constituted under the 15th Lok Sabha outside Delhi. The meeting was also attended by Minister of State for Railway Shri Adhir Ranjan Choudhary and 16 Members of Parliament representing Karnataka, Punjab, Uttar Pradesh, Jharkhand, Maharashtra, Andhra Pradesh, West Bengal & Assam, Railway Board members and other senior officers. This meeting has been held outside Delhi after four and half years, the last being in Udaipur in 2009. This meeting is the third meeting during the current year and second meeting under the chairmanship of Shri Mallikarjun Kharge. The main focus of the consultative Committee meeting was “Railway Claims System” and Members of the Committee gave valuable suggestions for further improvement in Railway Claims System.

Members of Parliament also gave their valuable suggestions for improvement in many other areas of Railway functioning, like train operations and passenger amenities etc. The members also placed demands concerning their constituencies. Hon’ble Minister of Railway assured the members that their suggestions and demands shall be looked into and directed Senior Railway officers for early implementation wherever feasible. The meeting was concluded in an amicable atmosphere and Hon’ble Minister of Railways thanked all members for their active participation and valuable suggestions.

DA JANUARY 2014-AICPIN FOR OCTOBER 2013

Consumer Price Index Numbers for Industrial Workers (CPI-IW) October 2013

According to a press release issued by the Labour Bureau, Ministry of Labour & Employment the All-India CPI-IW for October, 2013 rose by 3 points and pegged at 241 (two hundred and forty one). On 1-month percentage change, it increased by 1.26 per cent between September and October compared with 0.93 per cent between the same two months a year ago.

The largest upward pressure to the change in current index came from Food group contributing 2.53 percentage points to the total change. At item level, Rice, Wheat Atta, Fish Fresh, Goat Meat, Milk (Cow & Buffalo), Pure Ghee, Onion, Vegetable items, Tea Readymade, Electricity Charges, etc.. are responsible for the rise in index. However, this was compensated to some extent by Groundnut Oil, Ginger, Petrol, putting downward pressure on the index.

The year-on-year inflation measured by monthly CPI-IW stood at 11.06 per cent for October, 2013 as compared to 10.70 per cent for the previous month and 9.60 per cent during the corresponding month of the previous year. Similarly, the Food inflation stood at 15.02 per cent against 13.36 per cent of the previous month and 9.91 per cent during the corresponding month of the previous year.

At centre level, Bhavnagar recorded the highest increase of 9 points each followed by Ahmedabad, Labac Silchar and Kodarma (8 points each) and Vadodara and Surat (7 point each). Among others, 6 points rise was registered in 8 centres, 5 points in 10 centres, 4 points in 8 centres, 3 points in 9 centres, 2 points in 10 centres and 1 point in 11 centres. On the contrary, Belgaum and Chhindwada centres reported a decline of 3 points each followed by Mercara (2 points) and Salem, Hubli Dharwar and Puducherry (1 point each). Rest of the 15 centres’ indices remained stationary.

The indices of 39 centres are above All-India Index and other 38 centres’ indices are below national average.

The next index of CPI-IW for the month of November, 2013 will be released on Tuesday, 31 December, 2013. The same will also be available on the office website www.labourbureau.gov.in.

Implementation of Government decision on the recommendations of the Committee Secretaries Committee-2012-(Joint notification

Consequent upon issue of Govt. of India, Ministry of Defence letter No. 01(05)/2010- D(Pen-Policy) dated 17.01.2013, the families of Armed Forces Pensioners who got second employment in Central Civil departments or State Govt. / PSUs/ Autonomous bodies/ Local Funds of Central/ State Governments after getting retired / discharged from military service and were in receipt of ordinary family pension would be entitled to draw two family pension i.e., the Family Pension (Ordinary) from Military side in addition to the Family pension, if any, authorized by the re-employer for re-employed civil service subject to fulfillment of other prescribed conditions as hiethertofore.

2. In this regard this office has already issued circular No. 504 dated 17.01.2013 for grant of family pension from both side. There are plethora of complaints received in this office that in some cases in which joint notification has already been done by this office and Individual has been re-employed thereafter and family pension has been sanctioned from re-employer side then as per existing rules and note endorsed in the PPO, family pension has not been payable from Army side.


3. But now in consequence of the above cited GOI, MOD letter family pension will be payable from both side. In view of above it is hereby clarified that PDAs will make payment of family pension from both side i.e. Army side in addition to civil side w.e.f 24.09.2012, if he/she is otherwise eligible. In this regard PDA may endorse a note to this effect in the PPO that individual is re-employed and family pension from Army side is payable from 24.09.2012.

4. The provision of this circular shall be effective from 24th September 2012. This circular has been uploaded on this office website www.pcdapension.nic.in for disseminating across the all concerned.

Revision of service pension w.e.f 1.7.2009 and 24.09.2012 in terms of re-grouping of certain treads

Subject: Revision of service pension w.e.f 1.7.2009 and 24.09.2012 in terms of re-grouping of certain treads.

Reference: This office Circular No. 430 dated 10.03.2010, circular No 478 dated 13.02.2012 and 501 dated 17.01.2013.

Kindly refer this office circular No. 478 dated 13.02.2012 under which instructions  regarding re-grouping of certain trades in terms of Para 7.3 of circular No. 430 dated 10.03.2010 has been issued. Some PDAs have expressed doubts regarding revision of service pension on the basis of re-trading of group due to non-indication of trade in PPO.

 According to Para 7.3 of this office circular No. 430, religious teacher (RT), Lab Asst in AMC, Dresser in RVC & Driver MT are eligible for revised pension of Group ‘Y’. In this connection it is intimated that re-trading of group in AMC Records has been mentioned as” Lab Asst” which is clerical mistake in fact it is “Amb Asst”. It is also intimated that this office Circular No. 478 dated 13.02.2012 is applicable to all Pre-10.10.1997 PBORs/JCOs.

 In view of above, it is hereby clarified that PDAs will make payment of service pension according to this office circular No. 430 and 501 according to re-trade if PDAs satisfied about the trade of individual on the basis of available documents, otherwise forward the claim of such effective cases to this office for issue of corrigendum PPO according to this office circular No. 478 dated 13.02.2012.

SUBJECTS TAKEN UP FOR DISCUSSIONS IN THE JCM (DC) MEETING TO BE HELD ON 27.11.2013 - RAISED BY TN CIRCLE UNION

ITEM NO.3. Divisional arrangement/local arrangement in selection grade posts, irregular
clarification issued in Tamilnadu Circle.

Under para 3 of the CPMG Tamilnadu circle Memo No. STA/2-79/SK/11 dated 08.08.2012, it
is instructed that it should be ensured that no ineligible officials are allowed to officiate in
higher posts and that they should not be drawn the pay applicable to higher posts. It had
resulted in stoppage of drawal of officiating pay to the LSG officials who have been ordered
to officiate in HSG II and HSG I posts in the absence of the eligible officials as per
Recruitment Rules. The officiating arrangements for HSG II and HSG-I posts are being made
from the LSG officials only in the dearth of eligible officials for regular promotion. Further the
instructions issued in Tamilnadu circle is utter violation of Rule 50 of volume IV and also
vitiates the Directorate instructions dated 30.07.2012 on the subject.

It is therefore requested to kindly cause appropriate instructions to rescind the order and
allow officials to draw the entitled officiating pay as per the rules.

ITEM NO. 4. Non implementation of Delhi High Court orders on revision of pay scales of
Packers, Foreign Post, case of Chennai Foreign Post in Tamilnadu Circle.

Despite clear orders dated 17.08.2012 and subsequent clarifications dated 03.09.2012 of the
Directorate, the implementation of the orders has not been carried out by the Director,
Foreign Post Chennai till date.

The Directorate vide its letter and 04.09.2012 clarified that they should be allowed the pay
scale of Rs. 950-1500 w.e.f 01.01.1986 and further pay scale of Rs. 3050-4590 w.e.f
01.01.1996 and Rs. 5200-20200 with grade pay Rs. 1900 w.e.f 01.01.2006. Earlier the DoPT
as well as the Directorate clarified that the previous financial upgradation in respect of Group
‘D’ shall be ignored and will be provided fresh refixation after the introduction of MACP.
Similarly there was a pay scale fixed for the posts having the pay scale of Rs. 950-1500 for
TBOP and after 01.11.1991 for also BCR after the introduction of MACP similarly orders have
been communicated after 6th CPC about the pay scales applicable for TBOP and BCR for the
entry pay scale of Rs. 3050-4590.

As such the clarifications sought for by the Director Foreign post is nothing but to delay the
dues to be paid the officials. Similarly the clarification sought by him about the next grade pay
after fixing with Rs. 1900 is totally unwarranted. The Director mentioned that the Directorate
orders are not clear about refixation of pay to Group ‘D’ officials whether it is notional or
arrears to be drawn despite very clear clarification is issued by the Directorate on 04.09.2012
to give effect from 01.01.1986. It is pertinent to mention that in all the three Foreign Posts
other than Chennai, the pay fixation was already carried out and arrears were drawn. Further
promotions were also accorded under MACP thereafter.

It is therefore requested to kindly intervene and cause appropriate instructions to be
concerned at the earliest for pay refixation and also drawal of due arrears to the aggrieved
officials.

Item No.8. Dequarterisation of Post attached quarters - Decentralisation of power to PMG –
regarding.

A huge numbers of post attached quarters, specially those are lying with rented PO Building
are in worse condition. Most of the quarters are shabby, dilapidated and far below in
standard. Moreover almost all quarters are narrow and less in size considering the
entitlement of Posts. The urgent need of the day is dequarterisation of those post attached
quarters.The power of dequarterisation may be delegated to the regional PMGs who are
having close access to the concerned PO & area. Furthermore the power of suspension of
quarters beyond 90 days may also please be delegated to the regional PMGs in order to
avoid delay in drawal of due HRA to the incumbent officials.
It is requested to consider both the issues and cause appropriate orders at the earliest.

Item No.14. Refixation of Pay/Pension to BCR/LSG officials who have officiated in HSG I Posts –
case of Tamilnadu Circle regarding.

In Tamilnadu circle many BCR officials/LSG officials who were ordered to officiate in HSG I
arrangements on adhoc basis vide Chief PMG letter dt. 25.6.2004 were paid the officiating
pay in HSG I during the years from 2004 to 2006. The officiating pay of such officials was
taken for pension fixation prior to implementation of Sixth CPC duly taking the average
emoluments of such officials.

The drawal of officiating pay to BCR officials was stopped during 2007 and a reference was
made by the CPMG Tamilnadu Circle to the Directorate about the drawal of officiating pay to
the BCR officials who were officiated in HSG I arrangements around 81 and the same was
not disposed yet.

In the meanwhile, at the time of refixing the pension the DA (P) Chennai has not taken the
officiating pay sanctioned and drawn to the officials in between 2004 to 2006 which were
earlier taken for pension calculation based on the 10 month average. Resultantly officials
forced to approach the CAT vide OA No. 839/2011 and 840/2011 in which the Hon. CAT
directed the Department to revise and refix pay and pension of applicants by taking into the
revised pay applicable to the post HSG I in which they were ordered to officiate within a
period of 3 months. In addition to the four applicants of the case stated above, there are
around two or three cases similar to the above pending in Tamilnadu Circle.
Having offered to higher post and also drawn the officiating pay which was earlier construed
as pay for calculation of pension the denial of the same at the time of implementation of 6th
CPC is causing a concern. The copy of CAT Judgement was submitted earlier vide union
letter Dt. 03.05.2012.

It is therefore requested to kindly implement the orders and render justice to the aggrieved
officials.

Item No. 16. Applicability of various kinds of TA in Case of System Administrators.

A kind attention is invited to the Directorate letter No. 1/02/2011/PAP dated 17.01.2012, in
which the application of SR-25 has been prescribed in the case of System Administrators and
they have been asked to maintain log books for the grant of conveyance allowance.
It is pertinent to mention that the nature of the duties of the S.A cannot be equated with that
of the PRI (P) and the others. Whenever there is call to attend the fault, the SAs has to rush
to rectify the faults for immediate restoration of the system and office. Similarly all the
inspecting officer has been granted TA/DA including road mileage allowance to carry out their
duties.

As such if the SAs have to utilize public vehicle for their conveyance under TA/DA, it will
cause more dislocation in services. Further the nature of work of SA shall not warrant to look
after the faults so leisurely and they have to rush the spot to rectify the errors.

It is therefore requested to delete the provision of SR 25 and apply the road mileage
allowance in the case if the official utilize his own vehicle for official Journey.

Item No. 20. Creation of New Posts of System Administrators and Marketing Executives instead
of redeployment of the sanctioned PA posts.

At present, the Postal Assistants are being deployed to carry out the jobs of systems
Administratiors, Marketing Executives etc for which no establishment norms had been laid
down. Resultantly there is an absolute shortage in the operative works being carried out by
the Postal Assistants. Necessary action may please be taken for the creation of justified
Posts.

Item No.21. Penalising innocent officials in the name of minus balances.

Despite the fact that it was assured not to penalize the officials without evincing any action to
recover the minus balance from the depositors, the divisional heads are resorting action to
recover the amount from the innocent official by hook or crook by misusing the contributory
factors provisions. The AIPEU Group ‘C’ has sent a detailed note earlier about the cause,
effect and remedy in settlement of minus balance for which there seems no action.
It is therefore requested to kindly ensure not to recover any amount of minus balance from
the innocent officials without resorting action to recover the amount from the depositors
concerned.

Item No.23. Providing norms for BD, Technology, RTI oriented works and Project Arrow works.

No establishment norms as per SIU standard for works relating to BD, Technology, Project
Arrow and RTI oriented works has been formulated so far our knowledge goes. It is evident
that huge work hours for disposal of those items of works have already been created in
CO/ROs but no man power to deal with the cases has been provided due to non framing of
norms to adjudge the quantum of such work.

Item No.24. Irregular postings ordered in the LSG Promotion in some Circles :

In Some Circles, promotion is granted to the cadre of LSG (NB) based on the dates of
confirmation in the entry grade and not based in the DCCs. This has resulted in many junior
S.As/P.As getting promotion as LSG (NB), while senior P.As/ S.As have been deprived of
their due promotion. Clear clarification is required.

Item No. 35. Construction of Postal Staff quarters in Madurai.

Madurai City is the second biggest city in Tamilnadu State. The postal quarters built was converted as Postal Training Centre during 1985.As on date there is no postal quarters in the city. However Postal Dept. has acquired plots from Tamilnadu Housing Board at Ellisnagar (Madurai) scheme and proposal for constructions of staff quarters have been submitted during 1990s. Due to delay in approval of the proposal the site remains vacant for decades. Immediate approval as well as the allotment of funds is requested for the commencement of construction of Postal Staff Quarters at Madurai.

Item No. 52. Revision of Syllabus for Departmental Exams:

As the only avenue open to the cadre of Postman / MTS for higher promotion is that Postal Assistants through competitive examinations. The Department opted for revision of syllabus and pattern of examinations and the Staff Side to agree to it. It was told to us that the revision of syllabus and pattern of examinations would go a long way to help more candidates get through the examination to avoid many vacancies go unfilled after every examination. It took a long time for finalizing the syllabus and new method of examination introduced for LGO exam. However it is found that contrary to what was told by the Department the examinations of LGOs as well as the examinations from GDS to Postman and MTS have become so tough that it has become extremely difficult to answer many questions. This has led to a situation wherein the candidates could not get through these examinations and a large number of vacancies remain unfilled after the examinations.

Item No. 80. Replacement of outdated computer, Printers and prompt supply of computer stationeries.

In many POs, the computers are more than 10 years old and it could not cater to the present day
requirements. Many printers are out of service and there is no action to replace such systems and
printers. Many UPS are not in good condition. Further due to non supply of adequate funds,
Computer stationeries are not supplied and there are restrictions.All Circle heads may be directed to assess such accessories and replace them in a phased manner and ensure smooth functioning of the systems. Further when the demand of supply of Lazer Printers was taken up by the circle unions, it was replied that there is no plan provision for this activity and the matter has to be taken up with the Directorate. For the efficient and effective work, the supply of Lazer printers is a must.

Item No. 82. Enhancement of special casual leave for union meetings.

At present, 20 days have been allowed for the grant of special casual leave to the officials for
attending union meetings, circle conference, seminars etc. This is insufficient. Further in some circles, the days in which the union secretaries attending the Monthly Meetings/Bi-monthly Meetings are also construed as special casual leave instead of duty period as the formal meetings with administration will not cover up with other union meetings.

It is therefore requested to clarify the same and also to enhance the number of special casual leave to attend union Meetings/Seminars.

Item No.86. Engagement of Qualified GDS in vacant Posts of PA/SAs.

The shortage of staff in Postal Assistant/Sorting Assistant is very acute due to non filling of vacant
posts, prolonged officiating in LSG, HSG II & HSG I Posts, diversion of Posts to ME & System
oriented works, deputation to circle office etc. The officials are forced to look after two or three PAs works daily which causes erosion in efficiency and criticism from customers. In order to overcome the present shortage, it is requested to kindly cause orders to engage well qualified GDS available in the department on daily rated basis as if engaged in Postmen/Group ‘D’ short term vacancies.

Item No. 101. Grant of peripheral HRA in consonance with the List of Urban Agglomerations notified in 2011
Population totals released by the Census of India 2011 of Govt. of India, instead of awaiting for
dependency certificate years-to-gether from the respective collectors. It is well placed in the Census of India 2011 that the notified urban agglomeration is a continuous urban spread constituting a town and its adjoining growths. Instead of forwarding separate proposal, the Circle heads may be advised to collect all details and take up the proposals as one time. It will minimise the time and workload as well enable to issue early sanctions.

Item No. 102.Request to withdraw the extension of business hours up to 5.00 PM (total 7 hours) including Saturdays against ILO norms and against 5 day week- administrative office/ 6 day week – operative office principles.

As per the instructions contained in Dte. No. 11-2/2004-p. o. dt. 26.6.2012 instructions were issued
to all the Divisions/units in other regions also to revise/extend the business hours up to 17.00 hours based on demand and revenue and based on this in Tamilnadu Circle, in one region ordered
to extend the counter working hours for seven hours which results the closure of all offices late . The counter working hours should not be raised beyond five hours and six hours for bigger offices agreed upon earlier. It is requested to cause appropriate instructions in this regard.

Item No. 102. Maintaining LR strength and filling up the vacancies.

Due to acute shortage of staff, the existing LRPAs were positioned against regular vacant posts,
years-together, and slowly the LR P.A. S were amalgamated within the sanctioned strength mostly
in all the Divisions and the Rectt. was denied against the 10% LRPAs posts, as in the case of residual vacancies. Hence a thorough review is requested in order to restore the LR strength exclusively.

The undersigned is directed to say that in connection with the general elections to the Legislative Assemblies of some States, scheduled to be held in 2013, the following guidelines, already issued by DOPT vide OM No. 12/14/99-JCA dated 10th October, 2001, have to be followed for closing of the Central Government Offices including Industrial Establishments in the States:-

(i) The relevant offices/organizations shall remain closed in the notified areas where general elections to the State Legislative Assembly are scheduled to be conducted on the day of poll.

(ii) In connection with bye-election to Lok Sabha/State Assembly, only such of the  employees who are bona-fide voters in the relevant constituency should be granted special casual leave on the day of polling. Special Casual leave may alsp be granted to an employee who is ordinarily a resident of constituency and registered as a voter but employed in any Central Government Organization/Industrial Establishment located outside the constituency having a general/bye-election.

The above instructions may be brought to the notice of all concerned.

CGHS: Deletion of the name of ineligible Dependent & Opting out of the Scheme

 Text of DGHS No. D.12011/2/78-DESK –II, dt. 7.4.1978

Govt. Servant responsible for Deletion of the name of an ineligible Dependent

The undersigned is directed to state that in accordance with the definition of ‘family’ mentioned in Ministry of Health Memo. No. F.6(1) 1-54-H, dated the Ist May, 1954 the family of a beneficiary for the purpose of CGHS scheme includes husband/wife of the CGHS card-holder, as the case may be, wholly dependent children or step-children and parents, who are mainly dependent on and residing with the Government Servant. While it is incumbent upon the card issuing. Authorities, i.e. various departments and offices participating in the scheme, to ensure that the names of only genuine and eligible persons are included in the CGHS token cards, it is the responsibility of the employees concerned to apply for a deletion of the name of the dependent from the CGHS card, when the ward is no more entitled to the benefit eligible under the scheme. The failure on the part of a cardholder to get the name of a child deleted from the CGHS token-card when he is no more dependent on him is a good and sufficient reason for initiating disciplinary proceedings against him in terms of the CCS (CCA) Rules, 1965.

All Ministers/Departments of the Government of India are requested kindly to ensure that the above said provisions are complied with fully. These instructions may also be brought to the notice of all employees concerned.

Opting out of the C.G.H. Scheme
Spouse employed outside Central Government and availing Medical Facilities provided by his/her Employer

Central Government Servants covered under Central Govt. Health Scheme and whose spouse is employed in Defence or Railway Services, State Government or Corporations or Bodies financed partly or wholly by the Central or State Government, Local Bodies and private organizations which provide medical facilities to the employees and their family members, can opt out of the CGH Scheme and avail medical facilities so provided by the above mentioned organizations.

It is to be ensured that neither of the two nor their family members avail medical facilities from both the sources at the same time and for this purpose, the concerned Central Government employee shall give an undertaking to the authority issuing the CGHS Card.

Re-admission under CGHS after ‘opting out’
Such Government Servants, who have opted out of CGHS, may apply for readmission and avail the benefit of CGHS in case their spouse dies or resigns or is dismissed from the office/organization, which provided medical facilities.

Availability of ‘Opting Out’ Facility
The facility of opting out of CGHS can only be availed twice during the whole service career of the employee. Administrative Ministry/Department shall record the same by making an entry in the employee’s Service Book.

Govt workers want DA to be merged with salary

Government employees have asked the Centre to consider merging dearness allowance with their pay, arguing that the Sixth Pay Commission -- quite like the Centre -- could not have anticipated the high inflation that has eroded real wages over the last decade.

Since 2006 – when the recommendations of the last pay commission came into force – the dearness allowance has increased to 90%, a reflection of the high inflation environment that employees have to cope up with.

The demand was made at a preliminary meeting held between the department of personnel and the employee representatives to discuss the proposed Seventh Pay Commission announced by Prime Minister Manmohan Singh in September.

Congress media department chief Ajay Maken had asked the Prime Minister to announce the next pay commission in March this year. Writing in his capacity as a cabinet minister, Maken had also argued for a liberal increase in the salaries of government officials to attract and retain talent.

Representatives of government employees weren’t as optimistic.

Umraomal Purohit, secretary, staff side, however, did stress on the merger of dearness allowance (DA) with the basic pay. Purohit said that the sixth pay commission did not recommend merger as they could not have anticipated a high rate of inflation which resulted in employees being granted a 90% rate of DA.

Purohit and other representatives also emphasised that a system should be put in place to ensure that anomalies created due to recommendations of pay commissions should be resolved within a year of the implementation of the report.

Government sources said the pay commission could be notified over the next two months or so, well before the model code of conduct for the general elections kicks in. Also, the Centre is expected to give the panel enough time to prepare its report in the hope that the government would be a lot more comfortable vis-a-vis the fiscal deficit by the time the panel submits its report.

IRCTC LAUNCHES E-WALLET SCHEME FOR BOOKING TICKETS.

Indian Railway Catering and Tourism Corporation has launched e-wallet, a user-friendly scheme aimed at making purchase of e-tickets easier.

The e-wallet is a rolling deposit scheme wherein the customers will have an account with the IRCTC and deposit money to be used in future for booking e-tickets from its website (irctc.co.in), said a senior IRCTC official involved with the project.

Currently, one has to make the payment for the fare of the ticket, while booking e-ticket, through credit card, debit card or net banking. The process is a bit longer as the customer is transferred to the bank's server, from IRCTC's server, for making the payment and thereafter he is once again taken back into the IRCTC site which takes considerable time for booking a ticket, he said.

There have been instances when customer's login, in the IRCTC site, expires during this process and money is deducted from his bank account but he fails to get the ticket. The problem is being addressed with the launching of e-wallet scheme, he said.

Since the customer's money is already deposited with the IRCTC, he is not transferred to the bank's server for payment. This way precious time is saved and the chances of money deduction and not getting ticket are also nullified.

Only PAN card verified users can register this scheme and in case of ticket cancellation, the due refund will be credited to the e-wallet account next day.

MACP Scheme on Hierarchy or option to choose ACP: Secretary, MoUD letter to DoPT

Dear Dr. Sarkar,
Kindly refer to my DO letter of even No dt. 13.8.2013 in connect:on with redressal of disadvantageous provisions of MACPS for the Subordinate Engineering cadre and similarly placed cadres CPWD.

The proposal sent by this Ministry in Jul'2013 for allowing individual option to choose either earlier ACPS or MACPS by the employee is a balanced and just one and caters to the concerns of all individuals.  DoPT must not have any reservation in accepting the same since change of the scheme by the Government should not be to the disadvantage of the individual employee.

Already many court cases for review of the MACPS have cropped in. In this regard, would like to quote a Court Case (OA No. 275/2013) by some Assistant Engineers of CPWD for review of MACPS, draft counter reply to which quoting anomalous end disadvantageous provisions of MACPS was sent to DoPT for vetting. DoPT has not agreed to the reply and intimated that reply should be modified by the administrative ministry mentioning that operation of the both the schemes in the same cadre is against the provisions of MACPS other words individual option to employees to opt for either ACPS or MACPS is not permissible.

In this context, I would also bring to the notes that CAT, Chandigarh in OA No. 1038/2010 has allowed grant of financial upgradations under MACP in the promotional hierarchy, which has been upheld by Hon'ble High Court of Chandigarh in CWP 1938712011. Although the the case has not achieved fatality as the SLP had by the Government the in the Hon`ble Supreme Court was dismissed though not on merits but on account of non condonation of delay. Thus by allowing individual option. Government shall be saved of many expected court cases and possible grant of financial upgradations in the promotional hierarchy under MACPS.

Discontent in tno cadres is affecting the efficient functioning of the Department.  The problem shall further aggravate, if above proposal of this ministry does not find favour or DoPT in the circumstances would once again request to consider the proposal favourably, for allowing option to choose either ACP or MACPS by the individual.

As per previous post in MACP category MACP Scheme to the cadre of Junior Engineers of CPWD revoked, CPWD Engineers have to accept MACP Scheme on Grade Pay Basis.  Before the issuance of this circular by CPWD Dr. Sudhir Krishna, Secretary, MoUD urged to Secretary DoPT vide his D.O. letter to enable CPWD engineer to choose the option of ACP or MACP.  The contents of DO letter, which has been provided as image file by  Shri TKR Pillai, General Secretary, AIAAS(Non-Gaz) through his official blog, is reproduced below for reader of Central Government Employee News & Tools.  The reminder of this DO letter will be published in next post MACP Scheme on Hierarchy or option to choose ACP: Secretary, MoUD letter to DoPT:-

Dear Sayamal,

Issue of redressal of anomalous and disadvantageous provisions of MACPS for the Subordinate Engineering cadre and similarly placed cadres of CPWD has been taken up with DoPT through several proposals since Me very inception of the scheme but none of the proposals has found favour. This has resulted in great discontent to the Subordinate Engineering cadre of CPWD.

Above issue was also discussed with you informally on 1.8.2013. It was apprised that individual option to choose either earlier ACPS or MACPS by the employee is the only solution to cater to the concerns of all individuals. A proposal of this Ministry in this regard under consideration in DoPT.

As the matter concerns above 6000 subordinate Engineers of CPWD, I would request that they may be allowed to exercise their individual option to choose either earlier ACPS or MACPS. This will not only alleviate the discontent in the cadre but also avoid cropping up of the court cases.

10th bipartite talk wage settlement: Bank Unions will decide on strike action soon to press for early settlement of wages

The Hindu Business Line COIMBATORE, NOV. 9:

Bank employees have begun to voice their displeasure over what they call the Government's ‘casual’ approach in settling their wage accord, which is overdue.

The 9th wage settlement expired in October 2012. A year has passed but negotiations have hardly taken off, said C.H. Venkatachalam, General Secretary, All India Bank Employees Association (AIBEA).

The 10th bipartite talk between bank unions and Indian Banks Association (IBA) to decide on the quantum of wage increase for bank employees is currently on. Each settlement is valid for five years.

The current settlement would be valid from November 2012 to October 2017.

Rising discontent

IBA's slow approach has given rise to discontent among employees.

On the one hand, there has been a steep increase in living costs.

On the one hand, the Government arrived at a wage settlement for Central Government employees well before the expiry of the existing wage accord.

Venkatachalam said the United Forum of Bank Unions will decide on strike action soon to press for early settlement of wages.

Without disclosing the tentative date of strike, he said: “The Central Committee of the AIBEA is scheduled to meet at Allahabad on November 11 and 12 to chalk out further intensified programme, including strike action, to press for early settlement among others.”

When asked about the AIBEA’s demand, he said it has four or five priorities.

For instance, improvement in the dearness allowance compensation, which is now credited every quarter, should be made on a monthly basis and reflect the effect of inflation; there should be provision of housing accommodation for all including new recruits, who are posted in various places; full medical reimbursement should be provided for the employee and his/her family, and there should be better post-retirement benefits such as family pension and gratuity.

“And it's not just the package. The job as such should be made attractive, as the profile of the banking industry itself is undergoing a change,” he said.

To yet another query, he said the IBA has agreed that the settlement will become effective from November 2012.

“It has also agreed that the pay-scales will be reconstructed at 4,440 points against 2,836 points at present; but after that, nothing has happened. Even the date for the next round of talks has not been fixed. It is disheartening,” he said.

The 8th wage talks (covering the period 2002-07) provided bank employees with a 13.25 per cent increase in wages on an average while the 9th wage talks (2007-12) gave them a 17.5 per cent rise.
