Punjab announces 6 pc addl dearness allowance

Chandigarh, Apr 27 (PTI) The Punjab government has released 6 per cent Additional Dearness Allowance (ADA) installment with effect from January 1, 2011, on the Central government pattern to its employees and pensioners.

According to an official notification here today, following this decision present 45 per cent dearness allowance would be increased to 51 per cent on the basic pay from January 1 this year.

The government also decided to pay the increased DA in cash from May 1, whereas the arrears from Januray 1 this year to April 30 would be credited to their GPF Accounts.

Retired Employees of the state Government would get the same in cash from Januray one this year, an official spokesperson said.

Kendriya Vidyalaya Sangathan ties up with Union Bank for pay disbursement to employees

 NEW DELHI: Kendriya Vidyalaya Sangathan (KVS) and Union Bank of India today entered into an understanding for centralised salary disbursement of KVS employees across the country.

   Under the agreement, a comprehensive solution for disbursement of salary to all the 56,000 KVS employees will be offered by the bank through a customised web portal.

   The MoU was signed in the presence of Minister of State for HRD D Purandeswari and the bank's chairman-cum-managing director M V Nair.

   Nair said the web portal will carry salary details of all employees of KVS schools and regional offices and ensure "transparency" in the system.

   He said the system of salary disbursement developed by the bank for KVS will be capable of handling various other features like fee collection and management of schools funds, scholarship disbursement and management of funds under any grants and aid programme

SUMMARY RECORD OF DISCUSSIONS HELD DURING THE THIRD MEETING OF THE JOINT COMMITEE ON MACPS HELD UNDER THE CHAIRPERSONSHIP OF THE JOINT SECRETARY (ESTABLISHMENT), DOP&T ON 15TH MARCH 2011

The third meeting of the Joint Committee constituted to examine the anomalies pertaining to the MACP scheme was held under the Chairmanship of Joint Secretary (Estt.) Department of Personnel & Training on 15 th March, 2011. All the members of the Committee were present in the meeting.

2. The Chairperson welcomed the representatives of the Official Side and the Staff Side and stated that with respect item numbers 13, 21, 27, 28, 32, 38, 44, 50 & 58, suitable instructions had been issued vide this Department's O.M. dated the 1st November, 2010. She also informed that as per the decision taken in the second meeting of the Joint Committee, vide this Department's O.M. dated Both ! February, 2011, all concerned have been advised to review the cadre structure in a time bound manner with a view to mitigate the problem of stagnation

 3. Thereafter, the agenda items which were still pending were taken up for discussion.

Item numbers 1.3.8. 9 & 29- Grant of financial up-gradation in the promotional hierarchy instead of Grade Pay hierarchy under the MACPS.

The Staff Side reiterated their demand that the financial upgradations under the MACP Scheme should be granted in the promotional hierarchy of posts instead of the Grade Pay hierarchy. The Staff Side stated that the erstwhile ACP Scheme was implemented on the recommendations of the 5th CPC and, as such, has become a part of the service conditions of the employees. The Staff Side, therefore, contended that the Government cannot impose the MACP Scheme thereby altering the service conditions to the detriment of the employees.

The Official Side stated that the 6th CPC recommended two financial upgradations in the Grade Pay hierarchy after 12 and 24 years. However, the Government improved upon the recommendations of the 6th CPC and has implemented MACPS with three financial upgradations in the Grade pay hierarchy after 10, 20 & 30 years. Referring to earlier discussions held in the matter, the Official Side stated that the Government was willing to consider revision in para 13 of the MACP Scheme to the effect that organisations / cadres shall have the option to choose either the ACP Scheme or the MACP scheme. However, the Staff Side pointed that such a dispensation will not be practical and hence there is a need to explore other alternatives to solve the issue. After discussion, it was agreed that there is no need to change the basic structure of MACP Scheme. However, there is a need to separately examine those cases where MACP Scheme is less advantageous than the ACP Scheme. Accordingly, it was decided that the Official Side will write to the Ministry of Railways, Defence, Urban Development, Home and the Department of Posts to forward information in respect of the specific categories of employees where the MACPS is less advantageous than the erstwhile ACP Scheme The Official Side also requested the Staff Side to collect and forward such information to the Department of Personnel & Training for further necessary action.
In this connection, the Staff Side specifically pointed out the case of Technician category wherein under ACP (w.e.f 1.10.199) the staff got upgradation to Rs.4500- 7000 (V CPC) on completion of 24 years whereas under MACPS they get the same benefit, i.e. Grade Pay of Rs.2800 after 30 years.

Item Nos. 2,7,20 8 48- Date of Effect of MACP Scheme

The Staff Side stated that many employees who retired between 1.1.2006 and 31st August, 2008, have been deprived of the benefits of MACP Scheme and therefore, demanded that the MACP Scheme may be made effective from 1.1.2006. The Official Side stated that the matter was discussed and finalised in the second meeting of the Joint Committee and therefore, there was no reason to reopen the matter. After discussions, it was decided that the matter may be treated as finalised so far as the Joint Committee on MACP IS concerned and if required, the Staff Side may raise this issue in the next meeting of the National Anomaly Committee.

Item Nos.57-Grant of ACP benefit to Artisan Staff of the Ministry of Defence

The Staff Side stated that consequent upon the recommendations of the Fast Track Committee, the highly skilled Artisan Staff of the Ministry of Defence was bifurcated in two categories, i.e., Highly Skilled -11 (with Grade Pay of Rs.2400-) and Highly -Skilled-l (With Grade Pay of Rs.2800-). The Staff Side contended that this bifurcation, in the first instance, may be treated as placement and not as promotion for the purpose of MACP. The Official Side stated that as per the extant instructions of the Department of Personnel 8 Training, where the whole of a cadre is placed in a higher scale, such placement is not treated as promotion. However, when only a part of a cadre is placed in a higher scale, then such placement is treated as promotion for all purposes including MACPS. The Official Side further stated that even under the erstwhile ACP Scheme similar practice was followed and there is no reason to deviate from that.

The Staff Side cited a Supreme Court judgment in the case of Union of India Vs V.K. Sirotia reported in 1999 Supreme Court cases (L&S) 938 that where certain percentage of post are granted higher pay scales to seniors in the cadre will be treated as placement and not promotion. The Staff Side also cited the Manual of instructions for restructuring of cadres in 1.A & A.D (para 3.2.8) wherein it has been stated that the Screening Committee in combined Audit & Accounts Offices besides selecting persons for transfer to audit offices will also decide on their placement ( & not promotion) against the higher scale posts. After prolonged discussions, it was decided that the matter would be reexamined by the Department of Personnel & Training in consultation with the Department of Expenditure.

Item Nos. 12, 30 & 49 - Treatment of employees selected under LDCE Scheme /  GDCE Scheme.

The Staff Side demanded that employees selected under the LDCE Scheme/ GDCE Scheme should be treated as a direct recruit and their earlier promotions and services rendered should be ignored for the purpose of MACPS as was being done in the ACP Scheme. The Official - Side informed that treatment of such cases would generally be same in MACP as was in the ACP Scheme. Ministry of Railways would be advised to examine the matter accordingly.

Promotion in the identical Grade Pay The Staff Side raised the issue of promotions in the identical grade pay and demanded that in such cases the benefit of one increment should be granted at the time of promotion. 'The Official Side stated that if regular promotion is to the same grade pay, then MACP would also be granted to the same grade pay. On the issue of whether one increment is to be allowed in such cases, a reference has been received in the Department of Expenditure from Ministry of Railways. Further action in the matter would be taken consequent upon receipt of certain information from Ministry of Railways as called for by the Department of Expenditure.

4. . After discussion on the agenda items, the Staff Side stated that in many instances the provisions of the MACP Scheme were being misinterpreted by various Ministries/ Departments thereby causing financial loss to the employees. The Official Side stated that many Ministries / Departments had sought various clarifications regarding the provisions of the MACP Scheme which has been given.

In addition, many clarificatory Office Memoranda have also been issued by the Department of Personnel & Training to allay the misgivings misunderstandings regarding the Scheme. However, if certain misgivings/misunderstandings were still continuing, the respective Ministries/ Departments may be advised to refer the matter to the Department of Personnel & Training for resolution of the same.

5. In the end, it was decided that the recommendations of the Joint Committee on MACP Scheme along with the action taken report may be discussed in the next - meeting of the National Anomaly Committee.

CBSE proficiency test gets tougher

CHENNAI: The proficiency test to be conducted by the Central Board of Secondary Education (CBSE) for class 10 students is likely to be as tough as other competitive exams. The board has said that the test would include negative marking, a pattern followed by competitive entrance tests in the country like the IIT-JEE, AIEEE and AIPMT.

Announcing the dates for the optional proficiency test on its website, the CBSE said, "Negative marks will be awarded for wrong answers in different subjects as per the general guidelines. More than one answer indicated against a question will also be deemed as incorrect response and will attract negative marks."

Students who opted for the test are not excited about the negative marking system. Gautham Sekar, a student who will be taking the test, said, "The negative marking in a proficiency test will serve no useful purpose but will decrease our confidence."

Schools are not as worried. C Satish, senior principal, RMK Group of Schools, said, "The marks in this test are not going to adversely affect the student as they are not going to be used to secure admission to the senior secondary classes. The tests should be looked upon as an indicator of which stream the student should take in class 11."

The CBSE has brought in educational reforms that stress on round-the-year assessment of the student through the Continuous and Comprehensive Evaluation system.

It will be a paper-and-pencil test and all questions will be of multiple-choice type. The students will be required to mark the answers on a sheet provided at the test centre. The test will be based on the class 9 and 10 syllabi and will carry 100 marks. Students appearing for the test will be issued a certificate by the board indicating their percentile rank.

General guidelines and sample questions in each subject and information about the overall design of the question paper are available on the CBSE website.

Taking into consideration the convenience of the schools and candidates and the schedule of other major examination-related activities, the CBSE has planned the test in July. The mathematics test will be held on July 4, Hindi on July 5, science on July 6, social science on July 7 and English on July 8.

Subject: Revision of Stitching Charges.

            The undersigned is directed to say that based on a demand raised by the Staff Side, in National Council (JCM), the question of revising the Stitching Charges of Uniforms, supplied to Common Categories of employees (Multi-Tasking Staff - erstwhile Group 'D' posts of Peon, Daftry, Jamadar, Junior Gestetner Operator, Frash, Chowkidar, Safaiwala, Mali etc. and Staff Car Drivers, Dispatch Riders etc.) in the Central Secretariat and its Attached and Subordinate Offices, has been examined in consultation with the Ministry of Finance. Consequently, it has been decided to enhance the rates of stitching charges, with effect from 1st April, 2011 thereby modifying the earlier instructions issued vide this Ministry's O.M. No. 14/3/2006-JCA dated 28" September, 2006.

2. The revised rates of stitching charges, with effect from lst  April, 2011, will be as under:-

3. It may please be noted that the reimbursement of Stitching Charges at the-prescribed rates should be done only after the stitched uniforms are produced and are duly stamped, with indelible ink, at an appropriate place on the wrong side of the stitched dress, for identification. A proper record and procedure should be evolved to ensure that the employees produce the stitched uniforms within a reasonable period (say one month) after the cloth is supplied to them.

4. This issues with the concurrence of Department of Expenditure vide ID No. 5(1)/E.I1 (A)/2009 dated 08.04.201 1.

DA HIKE TO HIMACHAL GOVT EMPLOYEES

Subiect: Grant of Dearness Allowance to the employees of the State Government w.e.f. 01.01.2011

   In continuation of this Department’s OM of even number dated the 27th January, 2011, the Governor, Himachal Pradesh, is pleased to enhance Dearness Allowance from the existing rate of 45% to 51% with effect from 01.01.2011 in respect of the employees of the State Government.

   2. This additional Dearness Allowance of 6% (6 percent) shall be paid in cash with the salary of April, 2011 payable in the month of May, 2011 and the arrears accrued from 01.01 .2011 to 31 .03.2011 shall be credited to the GPF account of the employees. The interest on this account shall accrue w.e.f. 01.05.2011.

   3. Other terms and conditions as contained in CM of even number dated 26th August, 2009 shall continue to be applicable.

   4. The amount of “Adjustable Emoluments” if any, as mentioned in OM No. Fin(PR)-B(7)-1/2009 dated 09.09.2009 and 12.10.2009 shall be adjusted against the DA arrears and the net amount shall be credited in the GPF account of the employees.

   5. These orders will be applicable to employees covered by HP Civil Services (Revised Pay) Rules, 2009 and Work charged employees working in Government departments. These orders will also apply to All India Services Officers, HP Judicial Services Officers and State Government employees covered by UGC Pay Scales.

   6. The payment on account of Dearness Allowance involving fraction of 50 paise and above may be rounded off to the next higher rupee and the fraction of less than 50 paise may be ignored.

   7. As far as the PSUs/ Universities/ Autonomous Bodies/ Boards etc. are concerned, the managements of these PSUs/ Universities Autonomous Bodies/ Boards etc. would take an appropriate decision in this regard, considering the availability of resources in their organizations.

   8 In case of Government employees who have retired or who have closed GPF accounts and employees who are governed under Contribution Pension Scheme, the arrears on account of release of additional instalment of DA w.e.f. 01 .01 .2011 may be paid in cash.

   The undersigned is directed to refer to this Department ‘s O.M. of even number dated 31.3.2011 on the subject mentioned above and to say that it has been decided to substitute para 3 of this Department O.M dated 31.3.2011 ibid with the followings :-

     upon conclusion of DPCs, Cadre Units would retain officials to the extent of number of vacancies ( out of 877) allocated in their Cadre Unit as indicated in Annexure -I in the following manner:-

          a) All officers who have less than two years to superannuate as on lst May 2011 would be retained;

          (b) Remaining officers would be arranged in the ascending order of incumbency in the Cadre Unit and Officers with the least incumbency would be retained:

          (c) Cadre Units would furnish the recommendations of the DPC in respect of other eligible PAs, who are in the above Zone and clear from vigilance angle but could not be accommodated within the Cadre Unit due to lack of vacancies, to this Department by 01.05.2011 so that they could be promoted against the existing vacancies in PS Grade elsewhere. If any of the officials covered within the Zone specified above is on deputation, he/she may be given the option to revert within one month with a view to avail of the promotion”.

   2. In view of the above changes in para referred to above, information need to be sent about the officials superannuating within two years and those who have been retained on the basis of the least incumbency period in the Cadre Unit (Annexure -II) and DPC recommendations in respect of the PAs with maximum incumbency in the Zone prescribed above who could not be accommodated within the Cadre Unit ( Annexure-III).

   3. Other terms and conditions mentioned in this Department’s O.M. of even number dated 31.3.2011 will remain unchanged.

  Rule  18 (1)   (ii)  of  the   CCS  (Conduct)  Rules  have   provision  for   submission  o f   'Annual  property   returns   in  respect   of  immovable  property   by  all  Group  'A'  and   'B.officers  by  31st  January  of  each  year .  Conduct  Rules  for Railways  and   other   Rules  in  respect of Central Government  servants  contain similar provisions.

2  It  has  been  decided that   the  immovable property  returns  submitted  by members  of   all  Group  'A'  Services  of  the   Central  Government  for  the   year   2010   i.e.  a s   on 01 . 0 1 . 2 011  will  be  placed  in  public  domain  by  the   respective   cadre   controlling authorities  by  31.05.2011.  A  copy  of  the   circular  in  this   connection  issued  by Establishment Officer to all Ministries/Departments  is also enclosed herewith.

CBSE LAUNCHES ELIGIBILITY TEST FOR TEACHERS.

NAGPUR: The first ever central teacher eligibility test (CTET) will be conducted on June 26 by the Central Board of Secondary Education (CBSE). This test will be the qualifying exam for people intending to teach Classes I-VIII of central government-run schools where CBSE syllabus is taught.

The National Council for Teachers' Education (NCTE) had mandated a single eligibility test be held for teachers across the country. Clearing this test will now be mandatory for applicants who wants to teach at central government-run schools like Kendriya and Navodaya Vidyalayas. This was made mandatory under the Right To Education act (RTE) and the CBSE was asked to conduct the exam.

Private schools following CBSE syllabus may or may not insist on it. Also, existing teachers need not take it. It is only for new entrants. CBSE said in its website, "it is desirable to ensure that quality requirement for recruitment of teachers is not diluted at any cost. It is therefore necessary to ensure that persons recruited as teachers possess the essential aptitude and ability to meet the challenges of teaching at the primary and upper primary level."

The application forms for the exam will be available from April 15 and it can be submitted online till May 10. The exam will be on June 26 and results will be declared by July 27. There will be two tests held, Paper-I and Paper-II, on the same day. Paper-I will be for people who intend to teach classes I-V, and Paper-II for people who intend to teach classes VI-VIII. People wanting to be able to teach Class I-VIII will have to appear for both. There will be no negative marking.

Only candidates securing 60% and above will be issued the CTET certificate. The CTET will be held annually and its certificate will be valid for seven years. There are seven examination centres in Maharashtra with two being in Vidarbha (Nagpur and Amravati). The CBSE has also made it clear that schools owned and managed by the state government/local bodies and aided schools should consider the Teacher Eligibility Test (TET) conducted by the respective. However, a state government may make use of CTET scores for its schools if it wanted.

Subject:- Debarment of officers belonging to CSS/CSSS/CSCS on their refusal to promotion to next higher grade.

The undersigned is directed to state that this Department’s O.M. No. 16/1/79-CS.I,dated 3rd September 1983 on the subject mentioned above is hereby rescinded. In future,refusal of regular promotion to the next grade in CSS/CSSS/CSCS would be dealt with as per instructions contained in O.M. No. 22011/5/86-Estt.(D), dated 10th April 1989 of the Establishment Division. The relevant extract of the OM are given below:-
 
“17. 12- When a Government employee does not want to accept a promotion which is offered to him he may make a written request that he may not be promoted and the request will be considered by the appointing authority, taking relevant aspects into consideration. If the reasons adduced for refusal of promotion are acceptable to the appointing authority, the next person in the select list may be promoted. However, since it may not administratively possible or desirable to offer appointment to the persons who initially refused promotion, on every occasion on which a vacancy arises, during the period of validity of the panel, no fresh offer of appointment on promotion shall be made in such cases for a period of one year from the date of refusal of first promotion or till a next vacancy arises whichever is later. On the eventual promotion to the higher grade, such Government servant will lose seniority vis-a-vis his juniors promoted to the higher grade earlier irrespective of the fact whether the posts in question are filled by selection or otherwise. The above mentioned policy will not apply where adhoc promotions against short term vacancies are refused.”
 
This order will be effective prospectively in all cases of refusal of regular promotions after the date of this OM.

Subject:- Promotion of Assistant in the grade of Section Officer of CSS on ad- hoc basis — Extension thereof.

   The undersigned is directed to refer to this Department’s OM No. 6/9/2010-CS- I(S) dated 11.11.2010 on the captioned subject, wherein cadre authorities were allowed to continue the ad-hoc promotion in the grade of Section Officer upto 31.03 .2011.

   2. As the availability of regular Section Officers may take some more time, it has now been decided to extend the period of ad-hoc promotion in SO grade. beyond 31.3.2011 upto 30.06.2011 subject to the following conditions:-

     (I) The period of ad-hoc promotion would be upto 30.06.20 11 or till the regular Section Officers are made available, whichever is earlier.

     (II) The ad-hoc appointment shall not confer on the appointees any right to continue in the grade indefinitely or for inclusion in the Select List of Section Officers for regular appointment or to claim seniority in the Section Officers grade of CSS.

     (III) Ad-hoc appointment would continue till regular candidates in Section Officer Grade are available either through Seniority quota or Limited Departmental Competitive Examination (LDCE). In the event of the ad-hoc appointees not qualifying for regular appointment in either of these two categories, they shall be reverted to the Assistants’ Grade on availability of such regular officers from the date the regular Section Officers join duty in their respective cadre units allotted to them by this Department.

     (IV) No fresh ad-hoc promotion should be made in the grade of Section Officer.

Tamil Nadu govt directs employers to declare holiday on polling day (April - 13)

Tamil Nadu Government on Tuesday directed employers in the state to grant their employees a day’s holiday with wages on April 13 to enable them vote in the Assembly elections.
”It is mandatory on the part of every employer in Tamil Nadu to grant a holiday with wages on April 13,” a Labour Department note here said.
Such a measure was mandatory as per the provisions of Section 135 B of Representation of People Act, 1951.
‘Therefore the employers of all the factories, shops, establishments, commercial establishments, catering establishments, plantations, beedi establishments and motor transport undertakings are required to grant holiday with wages on April 13 to all their employees,” it said.

Public Holiday to employees to all Industrial, Commercial, Establishments and Shops for the General Election to be held on 13.04.2011.

The Election Commission of India has noticed 13.04.2011 as the day of poll for all the Tamil Nadu Assembley Constituencies.

Section 135B of the Representation of the people Act, 1951 requires that other person employed in any business, trade, Industrial undertaking or any other establishment should be granted holiday with wages in the day of poll. The Section further provides that no decution or abatement of the wages of any person shall be made on account of a holiday having been granted on the day of poll.

The Election commission in its letter No.78/2011/EPS dated:26.03.2011 has informed that the provisions of Section 135B require that the establishments and Shops shall be colsed on the day of poll in the constituency where a General Election is to be held. The Election Commission of India has further registered as an elctor, may be serving/ employed in an Industrial undertaking even those electors including casual workers working outsede the consitirency concerned would be entitled ot the benefirt oa a pod hokday extended uner Section 135b (1) of the representation of the People Act, 1951. Accroding to the Election Commission of India, daily wage/Casual workers are also ientitled for a holiday and wages on poll day as ptovided in Section 135 B of the Representation of the People Act, 1951.

in view of the provisions of Section 135 B of the Representation of the People Act, 1951 and the letters of the Election commission of India referred above, it is mandatory of the part of every employer in Tamil Nadu to grant a holiday with wages on 13.04.2011 to all persons employed by them. Therefore, the employers of all the factories, shops, establishemnts, commercial establishments, catering establishments, industrial establishments, Plantations, beedi establishments and motor transport undertakings are required to grant holiday with wages on 13/04/2011 to all their employees including daily wage/casual workers.

Subject: Grant of honorarium for translation from regional language to English/Hindi & vice-versa.

   In partial modification of this Department's O.M. No. 17013/86-Estt.(Allowance) dated 31st March, 1994 on the captioned subject, the President is pleased to decide that the rates of honorarium payable, subject to the ceiling of Rs. 5000/- per annum in each case for translation from regional languages to English/Hindi & vice-versa, will, hereafter be Rs.120/- per thousand words of Ordinary Material and Rs.130/- per thousand words of Technical Material (including Codes/Manuals, etc.)

   2. In so far as persons serving in the India Audit & Account Department are concerned, this issues with the concurrence of the Comptroller & Auditor General of India.

   4. These orders will be effective from the date of issue.

   5 . This issues with the approval of Ministry of Finance, Department of Expenditure vide their 1.D No. 14(2)/2011 -E-II(B) dated 10-03-2011.

OFFICE MEMORANDUM

Subject:       Rate of Dearness Allowance applicable w.e.f. 01.01.2011 to the employees of Central Government and Central Autonomous Bodies continuing to draw their pay in the pre-revised scale as per 5th CPC.

The undersigned is directed to refer to this Ministry’s Office Memorandum of even No. dated 11th September, 2010 revising the Dearness Allowance w.e.f. 1.7.2010 in respect of employees of Central Government and Autonomous Bodies who continue to draw their pay and allowances in the pre-revised scale of pay as per 5th Central Pay Commission.

2. The rates of Dearness Allowance admissible to the above categories of employees of Central Government and Central Autonomous bodies shall be enhanced from the existing rate of 103% to 115% w.e.f. 01.01.2011. All other conditions as laid down in the O.M. dated 3rd October, 2008 will continue to apply.

3. The contents of this Office Memorandum may also be brought to the notice of the organizations under the administrative control of the Ministries/Departments which have adopted the Central Government scales of pay.

Grant of Dearness Relief to Central Government pensioners/family pensioners — Revised rate effective from 1.1.2011.

OFFICE MEMORANDUM

Subject: Grant of Dearness Relief to Central Government pensioners/family pensioners — Revised rate effective from 1.1.2011.

   The undersigned is directed to refer to this Department’s OM No. 42/18/2010-P&PW(G) dated 27th September, 2010 on the subject mentioned above and to state that the President is pleased to decide that the Dearness Relief (DR) payable to Central Government pensioners/ family pensioners shall be enhanced from the existing rate of 45% to 51% w.e.f. 1st January, 2011.

   2. These orders apply to (i) All Civilian Central Government Pensioners/Family Pensioners (ii) The Armed Forces Pensioners, Civilian Pensioners paid out of the Defence Service Estimates, (iii) All India Service Pensioners (iv) Railway Pensioners and (v) The Burma Civilian pensioners/family pensioners and pensioners/families of displaced Government pensioners from Pakistan, who are Indian Nationals but receiving pension on behalf of Government of Pakistan and are in receipt of ad-hoc ex-gratia allowance of Rs. 3500/- p.m. in terms of this Department’s OM No. 23/1/97-P&PW(B) dated 23.2.1998 read with this Department’s OM No. 23/3/2008-P&PW(B) dated 15.9.2008.

   3. Central Government Employees who had drawn lumpsum amount on absorption in a PSU/Autonomous body and have become eligible to restoration of 1/3rd commuted portion of pension as well as revision of the restored amount in terms of this Department’s OM No. 4/59/97-P&PW (D) dated 14.07.1998 will also be entitled to the payment of DR @ 51% w.e.f. 1.1.2011 on full pension i.e. the revised pension which the absorbed employee would have received on the date of restoration had he not drawn lumpsum payment on absorption and Dearness Pension subject to fulfillment of the conditions laid down in para 5 of the O.M. dated 14.07.98. In this connection, instructions contained in this Department’s OM No.4/29/99-P&PW (D) dated. 12.7.2000 refer.

   4. Payment of DR involving a fraction of a rupee shall be rounded off to the next higher rupee.

   5. Other provisions governing grant of DR in respect of employed family pensioners and re-employed Central Government Pensioners will be regulated in accordance with the provisions contained in this Department’s OM No. 45/73/97-P&PW (G) dated 2.7.1999 as amended vide this Department’s OM No. F. No. 38/88/2008-P&PW(G) dated 9th July, 2009. The provisions relating to regulation of DR where a pensioner is in receipt of more than one pension, will remain unchanged.

   6. In the case of retired Judges of the Supreme Court and High Courts, necessary orders will be issued by the Department of Justice separately.

   7. It will be the responsibility of the pension disbursing authorities, including the nationalized banks, etc. to calculate the quantum of DR payable in each individual case.

   8. The offices of Accountant General and Authorised Public Sector Banks are requested to arrange payment of relief to pensioners etc. on the basis of these instructions without waiting for any further instructions from the Comptroller and Auditor General of India and the Reserve Bank of India in view of letter No. 528-TA, II/34-80-II dated 23/04/1981 of the Comptroller and Auditor General of India addressed to all Accountant Generals and Reserve Bank of India Circular No. GANB No. 2958/GA-64 (ii) (CGL)/81 dated the 21st May, 1981 addressed to State Bank of India and its subsidiaries and all Nationalised Banks.

   9. In their application to the pensioners/family pensioners belonging to Indian Audit and Accounts Department, these orders issue after consultation with the C&AG.

   10. This issues with the concurrence of Ministry of Finance, Department of Expenditure conveyed vide their OM No. 1(4)/EV/2004 dated 28th March, 2011.
